PRIVATE PROPERTIES: General Booking Terms and Conditions for Short-Term Rentals - Tenant

1. The Parties These general terms and conditions apply to the relationship between the following parties:

·      Private Properties ("PP"): Trade name of Private Properties Management S.R.L., with registered office at Foligno, Via Luigi Chiavellati 9/B and operational offices at Via Garibaldi 64, 06034 Foligno (PG), Italy and Viale Parini 20, 06018 Trestina (PG), Italy. Contacts: +39 0742 771729 and +39 345 2211974, info@privateproperties.it  Registered with the Chamber of Commerce of Perugia (REA no. PG - 361979, VAT no. IT 03301650543) and authorized to offer properties for short-term rental.

·       Tenant: The natural or legal person who takes the Property on a short-term lease through PP. PP enters into the contract with the Tenant by means of a separate booking confirmation specifying all terms, including these conditions and the Privacy Policy.

·       Owner: The company or private individual who legally owns the Property offered for rent through PP and presented to the Tenant by PP. The Owner's responsibilities may be delegated to another person (e.g., caretaker or Property manager).

2. Collaboration Agreement and Property

·       The Owner and PP have entered into a collaboration agreement for the short-term rental of the Property.

·       The Owner has authorized PP to offer and rent on their behalf the Property described on the websites www.privateproperties.it  and www.privatepropertiesrentals.com.

·       The Owner guarantees to PP that the Property enjoys a high level of maintenance: it is always clean, the garden is well kept, and the swimming pool is clean and ready for use during the specified opening periods.

·       The Owner is responsible for taking out adequate insurance for the house, contents, and third-party liability to allow hosting paying guests.

·       The Tenant is responsible for their own travel and personal liability insurance policy during the stay.

·       The Owner will guarantee the presence of an English-speaking person for check-in, troubleshooting during the stay, and check-out.

·       An updated guide in English regarding the operation of facilities and local tourist information will be available in the Property.

Stay Conditions and Prices

Rental Period and Availability

·       "Short-term rental" means the normal residential use of the Property by the Tenant during the confirmed period.

·       The maximum length of the lease is 30 consecutive days.

·       The standard period is one week: Check-in from 4:00 PM CET on the Saturday of arrival and Check-out by 10:00 AM CET on the Saturday of departure, unless otherwise specified on PP's websites or agreed in advance.

·       With the Owner's approval, PP may agree on different days or times for arrival and departure.

·       PP will publish the availability of the Property online at www.privateproperties.it and www.privatepropertiesrentals.com.

Prices and Payments

·       Rental prices, security deposit, and additional services are expressed in Euros (EUR) in the confirmation email and on the websites.

·       All prices include applicable taxes (e.g., VAT), except for the municipal Tourist Tax (if due), which must be paid separately according to the procedures specified in the booking confirmation.

·       Payments will be made through the www.payrider.com platform or by bank transfer.

·     PP does not accept or send payments in currencies other than the Euro (EUR). If the Tenant wishes to pay in another currency, they will be solely responsible for the costs and exchange rates applied by their bank. Neither PP nor the Owner shall be liable for any variations in exchange rates or conversion fees.

Included Services and Security Deposit

·       The Owner guarantees that all facilities listed in the web profile are in excellent condition. This includes the opening and cleaning of the pool (during specified periods), equipment functionality, and optimal year-round garden maintenance.

·       The use and maintenance of all facilities, including final cleaning, are included in the rental price, unless otherwise specified on the websites.

·       The Owner will remove or securely store personal valuables prior to the Tenant's arrival.

·       The Tenant must pay a security deposit to PP, which will hold it in trust accounts until the end of the rental period.

·       The deposit will be refunded in full provided there is no damage or missing items.

·       The parties are required to report any damage or missing items immediately upon discovery.

·       If the Tenant causes damage or loses items, the Owner has the right to request repair or replacement costs.

·       The Owner may report any issues directly to the Tenant during the stay or to PP (via email) within a maximum of two days after departure.

·       Upon receipt of the repair/replacement invoice from the Owner within two months of departure, PP will transfer the amount to the Owner. Any remaining deposit amount will be refunded to the Tenant.

·       If costs exceed the deposit, the Tenant will pay the difference directly to the Owner within 10 days of receiving the invoice through PP. In this case, PP will transfer the entire deposit to the Owner.

·       In the absence of communication within two days of departure or invoices within two months, PP will refund the full deposit to the Tenant.

·       Under no circumstances is PP responsible for any damage or missing items.

Additional Services upon Request Upon the Tenant's request and subject to availability, PP can manage extra services. There are two categories:

·       Services managed by PP: Includes services such as pool heating, extra cots/beds, and extra cleaning for pets, booked and paid through PP.

·       Services managed by the Owner: Includes shuttles, groceries, chef, babysitter, massages, extra cleaning, extra linens, firewood, sale of local products, etc. These must be booked through PP at least one week prior to arrival. Payment must be settled in cash directly between the Owner and Tenant, at the latest upon departure.

·       The security deposit cannot be used to pay for these services, nor is PP responsible for non-payment.

Booking and Cancellation Procedure

Instant Booking:

Booking Steps

·       Instant Confirmation and Deposit: The booking is confirmed instantly upon payment of a deposit equal to 30% of the total and provision of the Tenant's full address. By paying, the Tenant accepts the Booking Terms and the Privacy Policy. In addition, the Tenant must fill out the form with the personal details of all guests, as required by local authorities.

·       Balance Payment: The Tenant must pay the remaining 70% of the total (together with the security deposit and any extra services) 10 days prior to the check-in date.

·       Payment Completion: Payments are processed via www.payrider.com or bank transfer.

·       Voucher: Upon receipt of all payments and required details, PP will send the Tenant a voucher with Property details, Owner/caretaker contact info, and driving directions. This voucher will serve as official identification upon arrival. PP will maintain records to allow the Owner to contact the Tenant if necessary, always in compliance with Privacy terms.

Cancellation or Postponement If the Tenant cancels the booking, they must notify info@privateproperties.it via email.

·       The Tenant will receive a full refund (100%) of booking costs if they cancel up to 5 days before the check-in date (by 12:00 PM CET).

·       In case of cancellation made within the last 5 days prior to check-in or a no-show, no refund will be provided.

·       All cancellations must be made by 12:00 PM (CET) on the specified day.

·       If a Tenant cancels and has paid full rent, PP has the right to offer the Property to others, making separate arrangements with the canceling Tenant.

·       Only if the Property becomes uninhabitable (e.g., severe damage), will the Tenant receive back all sums paid without further liability for PP or the Owner.

·       If the Property is sold prior to the start of the stay and the new owner refuses to honor the booking, it may be canceled without penalty and the Tenant will receive a full refund of all amounts paid. In this case, PP will endeavor to offer alternative accommodation to the Tenant, it being understood that PP cannot in any case be held responsible for the occurrence.

·       In cases of force majeure (e.g., public authority restrictions), PP may agree with the Tenant on a new period in the same Property for at least the same value paid, within the following calendar year. Only on this occasion will the security deposit be returned to the Tenant and subsequently re-paid.

Booking on Request:

Booking Steps

·       Options: The Tenant may request an option on the Property for a maximum of three calendar days. PP will check availability; upon expiration of the three days, the option expires or converts into a booking. Direct booking is also possible by sending an email to info@privateproperties.it

·       Information and Confirmation: PP will send an email with booking details, conditions, and payment instructions. The Tenant must pay PP a confirmatory deposit equal to 30% of the total and provide contact details. In addition, they must complete the form with personal details of all guests, as required by local authorities.

·       Completion: Payment is managed through www.payrider.com or bank transfer.

·       The booking is confirmed upon receipt of the deposit and full address of the Tenant. By paying, the Tenant accepts the Booking Terms and Privacy terms. If payment or address is not received within 5 calendar days, PP may cancel the booking without further liability.

·       Balance Payments: The Tenant will receive a reminder to settle the price, security deposit, and extra services at least 4 weeks before the rental start date. Payment will always be via www.payrider.com or bank transfer.

·       Last-Minute Bookings: For bookings confirmed 21 days or less prior to arrival, the full amount must be settled in a single payment via bank transfer. PP will provide bank details and require a receipt to secure the booking. These payments cannot be handled via www.payrider.com.

·       Voucher: Upon receipt of all payments and data, PP will send the Tenant a voucher with Property details, Owner/caretaker contact info, and driving directions. This voucher will serve as official identification upon arrival. PP will maintain records to allow the Owner to contact the Tenant if necessary, always in compliance with Privacy terms.

·       If canceled up to 1 month before check-in, 50% of the booking costs will be refunded.

·       If a Tenant cancels and has paid full rent, PP has the right to offer the Property to others, making separate arrangements with the canceling Tenant.

·       Only if the Property becomes uninhabitable (e.g., severe damage), will the Tenant receive back all sums paid without further liability for PP or the Owner.

·       If the Property is sold prior to the start of the stay and the new owner refuses to honor the booking, it may be canceled without penalty and the Tenant will receive a full refund of all amounts paid. In this case, PP will endeavor to offer alternative accommodation to the Tenant, it being understood that PP cannot in any case be held responsible for the occurrence.

Rules for the Stay

Arrival (Check-in) and Guest Notification

·       Italian law requires guest notification to local authorities (police). The Tenant must comply by providing personal data through PP to the Owner. The Parties undertake to comply with PP's Privacy Policy.

·       The Owner, or a representative, will be present upon arrival. The Tenant must arrive within the time window specified on the voucher.

·       The Tenant is requested to communicate the approximate arrival time the day before. For unagreed very early or late arrivals, the Owner may charge an extra fee.

·       The Tenant must respect the maximum number of people and pets allowed per the booking. In case of excess, the Owner has the right to turn away excess people or animals. Alternatively, with PP's mediation, they may allow them to stay upon payment of extra costs. Under no circumstances may the maximum capacity indicated on the PP website be exceeded.

Tenant Behavior and Owner Liability

·       The Owner will provide a clear point of contact for questions or emergencies during the stay.

·       The Owner will ensure the presence of an updated guide in English.

·       All indoor covered spaces are non-smoking, and use of the pool or garden equipment is at the Tenant's own risk. Children under 12 must be supervised by at least one adult.

·       It is strictly forbidden to move furniture, take indoor furnishings outside, or use them for unintended purposes.

·       Failure to respect these rules or damage to the Property gives the Owner the right to terminate the rental or evict the Tenant, potentially with the assistance of local authorities. PP disclaims all liability in the event of disputes.

Departure (Check-out)

·       The Owner, or a representative, will be present at departure.

·       Except for final cleaning, the Tenant must leave the property in a tidy condition, similar to how it was found.

·       The Tenant must vacate the Property by the time specified in the profile and voucher. Please inform the Owner of the approximate departure time the day before.

·       The Tenant must pay for unsettled extra services, in the exact amount and in cash, by the time of check-out. The Owner may not have change, and these amounts cannot be deducted from the security deposit.

·       In the event of an unannounced departure, the Owner may charge a departure fee, plus any damage or unpaid services subject to an administrative fee.

Rebooking and Video Surveillance

·       If the Tenant intends to rebook the Property in the future, they will continue to do so through PP for as long as PP promotes the property.

·       If the Tenant purchases the Property from the Owner, they must inform PP immediately and recognize a commission according to the brokerage terms in force.

·      In the case of video surveillance cameras, those inside private spaces will be deactivated. Property security cameras outside must: film only the Owner's premises, limit privacy violations of passersby, delete footage after 24 hours, and display clear signage for the Tenant. Images may be shared with police in the event of a criminal incident.

Legal Terms

Disclaimer and Complaints

·       PP respects the privacy of all customers. The Privacy Policy is sent attached to the confirmation and describes the use of requested data. A copy can also be downloaded or requested via email.

·       PP relies on information provided by the Tenant and Owner and is not responsible for inconvenience or damage resulting from missing or incorrect information.

·       As PP acts solely as an intermediary, its liability under the contract is excluded.

·       The Owner declares that their liability for any direct damage is limited to the agreed rental price amount for one week.

·     Complaints regarding the agreement or Property will be handled immediately by contacting the reference person. Any complaint must be submitted at the time of discovery and, at the latest, within 3 days of the end of the stay if it was not possible to resolve it immediately.

Dispute Resolution

·       The parties acknowledge that Italian law applies to the Booking Terms, confirmation, and Privacy terms.

·       Any dispute will be submitted to the competent jurisdiction of Perugia (Italy), although PP (on behalf of the Owner) may also initiate a claim in the competent court of the Tenant's jurisdiction.
